GOTRANSIT TERMS OF USE

We thank you for Your trust in the GoTransit service in the Gojek Application and the GoPay Application. Please take Your time to read the whole Terms of Use of GoTransit ("GoTransit Terms of Use"). This GoTransit Terms of Use is an integral part of Gojek Terms of Use. By using the GoTransit Service on the Gojek Application, You will be deemed to have read and agreed to the GoTransit Terms of Use, and by using the GoTransit service on the GoPay Application, you will be deemed to have read and agreed to GoTransit Terms of Use and all relevant terms and conditions regarding the GoPay Application and all features therein issued by our affiliate, PT Dompet Anak Bangsa, as accessible to you via the GoPay Application. Therefore, if You do not agree to part or all of the conditions of the GoRide Terms of Use, please discontinue the use of GoRide Service.

1. GENERAL TERMS

Unless specifically defined below or elsewhere in these GoTransit Terms of Use, capitalized terms used herein shall be interpreted in accordance with the terms set out in the Terms of Use.

GoTransit is one of the services available within the Gojek Application, whereby Gojek/We provide a platform in the form of the Gojek Application and PT Dompet Anak Bangsa provides a platform in the form of the GoPay Application, enabling You to use the GoTransit services provided by GoTransit Partners or Service Providers, with details as set out in these GoTransit Terms of Use.

GoTransit Partner is a business entity acting as a Service Provider of public transportation that carries out public transportation business activities and has agreed to cooperate with Us to connect and provide independently-managed public transportation services through GoTransit, in accordance with applicable laws and regulations.

2. GENERAL MATTERS ON GOTRANSIT SERVICES

2.1 GoTransit is one of the services available within the Gojek Application and/or GoPay Application to provide GoTransit Services, including:

a) an aggregator of relevant information for public transportation services provided by GoTransit Partners;

b) a trip planner enabling You to plan trips using public transportation provided by GoTransit Partners and/or services provided by Service Providers, available within the Gojek Application;

c) a platform to facilitate booking and payment transactions between You and Service Providers and/or GoTransit Partners; and/or

d) other GoTransit information or features that We may add from time to time.

2.2 In providing GoTransit, We act as an aggregator of information regarding public transportation services provided by GoTransit Partners to You, including information on the location of bus stops or stations, the location of GoTransit Partner or Service Provider fleets, GoTransit fleet departure schedules, and other relevant information.

We also provide other information to make it easier for You to plan Your trip, such as travel routes, estimated travel time, information on intermodal transit locations, transportation mode options, travel maps, and other relevant information.

3. GOTRANSIT SERVICE TERMS

3.1 You understand and agree that We provide the GoTransit service for the purpose of making Your travel easier by providing information on trip plans and public transportation service options to You, which are non-binding recommendations. The information and services available within GoTransit are provided by third parties to Us, which We then present to You within GoTransit.

3.2 You understand and agree that all GoTransit services and features as described in Article 2 of this GoTransit Terms of Use may, from time to time, be made available or become unavailable at Our absolute discretion.

3.3 You understand and agree that any travel time and fare shown within GoTransit are non-binding estimates. We do not guarantee that any trip plan You create within GoTransit will actually correspond to the estimated time and fare shown within GoTransit. You further understand and agree that Your actual travel time and fare may be affected by matters beyond Our control, including but not limited to: weather conditions, traffic congestion conditions, driver conditions, traffic management conditions by the relevant authorities, vehicle conditions, and other such matters.

3.4 You understand and agree that the public transportation service options You may book and purchase through GoTransit are services provided by GoTransit Partners as a third party, and constitute a relationship separate from Your relationship with Us, arising independently between You and the relevant Service Provider or GoTransit Partner. Accordingly, You hereby release and discharge Us and Our affiliates from any and all liability, obligations, losses, lawsuits, demands, claims, litigation proceedings, and/or requests of any kind from You arising out of the transactional relationship between You and the Service Provider and/or GoTransit Partner.

In respect of such bookings and purchases, We act as the provider of the booking and payment facility for Your use of public transportation services provided by the Service Provider or GoTransit Partner. We and/or Our affiliate, PT Dompet Anak Bangsa, do not act as an agent or representative of the Service Provider or GoTransit Partner. Your transactions for the purchase and use of public transportation services from a GoTransit Partner shall be subject to the terms and conditions provided by that GoTransit Partner, as additional terms to these GoTransit Terms of Use.

3.5 You understand and agree that We and/or Our affiliate, PT Dompet Anak Bangsa, cannot control the Service Provider and/or GoTransit Partner in their provision of public transportation services to You through GoTransit. You further understand and agree that the relationship between You and the Service Provider and/or GoTransit Partner is separate from Your relationship with Us, arising independently between You and the Service Provider and/or GoTransit Partner. Accordingly, You hereby release and discharge Us and Our affiliates from any and all liability, obligations, losses, lawsuits, demands, claims, litigation proceedings, and/or requests of any kind from You arising out of the transactional relationship between You and the Service Provider and/or GoTransit Partner.

3.6 You understand and agree that We provide no warranty whatsoever and shall bear no responsibility whatsoever for any outcome arising from Your use of the information and services available within GoTransit. This includes but is not limited to: the punctuality of the mode of transportation, the accuracy of travel costs, the accuracy of travel duration, Your safety and security while traveling, the security of Your belongings during the trip, Your satisfaction with the driver and the condition of the vehicle You choose, Your certainty of reaching Your travel destination, and other matters relating to Your trip and Your satisfaction in using the GoTransit service.

3.7 You understand and agree that You are responsible for Yourself and for any other person You bring along on Your trip. You are obligated to comply with the applicable laws and regulations during Your trip and while using the public transportation services You use during Your trip.

3.8 We are not liable for your use of the information and/or itinerary recommendations we provide. Any decision to use the itinerary recommendations we provide is entirely yours, and you bear sole responsibility for that decision. You hereby agree to release and hold us, including our affiliates, harmless from any liability, obligation, loss, lawsuit, demand, claim, litigation, and/or request from any party (including yourself) arising from your decision to use the information and/or itinerary recommendations we provide.

3.9 You understand and agree that, through your use of GoTransit, you may be connected to services provided by third parties that are governed by separate terms and conditions. You are required to read such terms and conditions and comply with all applicable provisions.

4. USER REPRESENTATIONS AND WARRANTIES

4.1 The User representations and warranties set out in this Article 4 are in addition to the representations and warranties given by the User as contained in the Terms of Use. Nothing in this Article 4 shall reduce or limit the applicability of the representations and warranties given by the User in the Terms of Use.

4.2 You represent and warrant that You are aware of and understand the risks involved in Your trip, including but not limited to the possibility of accidents and criminal acts against You.

4.3 If You experience a loss or problem during Your trip using services provided by the Service Provider and/or GoTransit Partner, including as a result of an accident caused by the negligence of the Service Provider and/or GoTransit Partner or a traffic violation, We may endeavor to help connect You with the relevant Service Provider and/or GoTransit Partner in an effort to seek resolution of the matter. We have no obligation whatsoever with respect to any problem or dispute arising between You and the Service Provider and/or GoTransit Partner.

4.4 You represent and warrant that in using the transportation services provided by the Service Provider and/or GoTransit Partner, You will comply with applicable laws and regulations and applicable norms. You understand and agree that the Service Provider and/or GoTransit Partner has the right to refuse Your request or to refuse to provide services to You, if the Service Provider and/or GoTransit Partner suspects that You have violated, or that by accepting Your request You will or have violated, applicable laws and regulations, the GoTransit Terms of Use, and/or other applicable terms of use relevant to the service You are using.
